1. Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Mystic Yunnan International Travel (Hong Kong) Limited (“ChinaMystic,” “we,” “us,” or “our”), a travel agency registered in Hong Kong SAR. By booking or participating in any tour or service offered by ChinaMystic, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms govern all travel services provided by ChinaMystic, including but not limited to tours, accommodation bookings, transportation arrangements, and related activities, primarily focused on inbound travel to Yunnan, Xizang (Tibet), and Xinjiang, China.
2. Booking and Payment
2.1 Reservation: To make a booking, please contact us via our website (chinamystic.com), email, or other official channels. Bookings are subject to availability and confirmation by ChinaMystic.
2.2 All-Inclusive Pricing Policy: At ChinaMystic, we practice transparent pricing. The tour price quoted on our website at the time of booking is All-Inclusive. This means the price includes all applicable service taxes, local taxes, and credit card processing fees. We guarantee that no additional booking fees or hidden taxes will be added to your total during the checkout process.
2.3 Deposit: A non-refundable deposit is required to secure your booking. The standard deposit is 30% of the total tour cost per person. For tours involving special permits (e.g., Tibet) or during peak seasons, a higher deposit may be required, which will be advised at the time of booking. The payment of the deposit confirms your acceptance of these Terms.
2.4 Final Payment: The remaining balance of the tour cost is due 45 days prior to the scheduled departure date. Failure to pay the balance by the due date may result in the cancellation of your booking and forfeiture of your deposit.
2.5 Late Bookings: For bookings made within 45 days of departure, full payment is required at the time of booking to confirm the reservation.
2.6 Payment Methods: * Secure Online Payments: We accept Visa, Mastercard, and American Express. All transactions are securely processed through PCI-compliant partners such as Stripe, PayPal, and Airwallex. Your booking is typically confirmed instantly upon a successful transaction.
- Bank Transfer (Wire Transfer): Available for larger booking amounts. While we do not charge a booking fee, you remain responsible for any fees charged by your own sending bank associated with the wire transfer.
2.7 Waitlist Policy: For tours that are fully booked, you may choose to join our Waitlist. Joining a waitlist does not guarantee a spot or lock in the current price. We will notify you via email if a spot becomes available, and bookings will be handled on a first-come, first-served basis at the price effective at the time of formal booking.
3. Cancellation and Refund Policy
Cancellations must be submitted to ChinaMystic in writing via email. The date of cancellation is the date we receive your written notification.
3.1 Cancellation by the Client: Due to the advance arrangements required for permits, accommodations, and transport in remote regions, the following charges apply:
- 45 days or more prior to departure: Full refund of all monies paid, minus the non-refundable deposit.
- 30 to 44 days prior to departure: 15% of the total tour cost will be charged.
- 15 to 29 days prior to departure: 50% of the total tour cost will be charged.
- 8 to 14 days prior to departure: 80% of the total tour cost will be charged.
- 7 days or less prior to departure, or no-show: 100% of the total tour cost will be charged.
Non-Refundable Items: Costs for special permits (e.g., Tibet Entry Permit), issued flight/train tickets, and specific non-refundable hotel bookings are deducted from any potential refund regardless of the cancellation date.
3.2 Cancellation by ChinaMystic: We reserve the right to cancel a tour for reasons such as insufficient participant numbers. In such cases, we will offer a comparable alternative tour or a full refund of all monies paid to us. We are not liable for incidental expenses like visa fees or non-refundable connecting flights.
3.3 Force Majeure: ChinaMystic shall not be liable for cancellations or alterations due to Force Majeure events (e.g., natural disasters, government restrictions, pandemics). We will assist with alternative arrangements or documentation for your travel insurance claims.
4. Alterations to Bookings
4.1 Changes by the Client: Requests for changes (dates, itinerary) are subject to availability. An administrative fee of USD 75 per change per person plus any supplier-imposed costs will apply. 4.2 Changes by ChinaMystic: We reserve the right to modify itineraries due to local conditions or safety concerns. Significant changes made before departure allow you to accept the change, book an alternative, or cancel for a refund as per Section 3.2.
5. Client Responsibilities
5.1 Travel Documents: You must possess a valid passport (6 months’ validity) and obtain all necessary visas and permits. ChinaMystic assists with Tibet permits but does not guarantee issuance. 5.2 Health and Fitness: You must be in sufficiently good health for the tour, especially for high-altitude travel (>3,000 meters). You must disclose pre-existing medical conditions at the time of booking. 5.3 Travel Insurance: Comprehensive travel insurance is mandatory. Your policy must cover trip cancellation, medical expenses (including emergency evacuation from remote/high-altitude areas), and personal liability. 5.4 Conduct: We reserve the right to terminate your participation without refund if your conduct is disruptive, offensive, or dangerous. 5.5 Assumption of Risk: You acknowledge that travel to remote areas carries inherent risks and agree not to hold ChinaMystic liable for events beyond our reasonable control.
6. Liability and Limitations
6.1 Our Role: ChinaMystic acts as an agent for independent third-party suppliers (airlines, hotels, local guides). We do not own or control these entities. 6.2 Limitation of Liability: We are not liable for injury, death, loss, or delay arising from acts of third-party suppliers, Force Majeure, or your own negligence. 6.3 Financial Cap: Our total liability for any claim shall be limited to the total amount paid by you to ChinaMystic for the specific tour package in question.
7. Data Protection
We process personal data in accordance with our Privacy Policy and the laws of Hong Kong SAR (PDPO) and GDPR.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes shall first be attempted to be resolved via amicable negotiation, then mediation (e.g., HKIAC), and finally through the courts of Hong Kong SAR.
9. Amendments to Terms
ChinaMystic reserves the right to update these Terms at any time. The current version will be posted on chinamystic.com.
